Please read these terms and conditions carefully before using the website operated by Chancellor Formecon Ltd (("Chancellor Formecon"), "our", "we" or "us") (Company Number: 01049487 and VAT number: GB 278 9012 29). In particular, we draw your attention to clauses headed 'Applicability of online materials' and 'Liability'. By checking the box indicating your acceptance to the terms and conditions, you agree to be legally bound by these terms and conditions as they may be modified and posted on our website from time to time.
Without prejudice to the above, by checking the appropriate box indicating your acceptance of these terms and conditions and/or by using or accessing our website, you agree to be legally bound by these terms and conditions of use as they apply to your use of or access to our website.
If you do not wish to be bound by these terms and conditions then you may not use our website.

Nature of our website
Our website is a place for you to select and order from our extensive product portfolio including standard forms, notices, booklets, folders, starter packs, and other associated items (the "Products"). Our website describes the Products in more detail.
Buying products on our website To order a product you will need to follow the ordering procedures set out on our order page. Details of our prices for the Products, and the procedures for payment and delivery are displayed on our website.
Any delivery dates stated on our website are estimates only. Chancellor Formecon will make all reasonable effort to deliver goods within the time specified, but does not accept liability for any failure to deliver within that time.
You must pay by credit or debit card at the time of order. The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see below). We will inform you if a Product's correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. The prices are exclusive of delivery costs and applicable taxes.
Chancellor Formecon is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online electronic means ("Confirmation") to the e-mail address you have given us on ordering.
You undertake that all details you provide to us for the purpose of purchasing goods or services which may be offered by us on our website will be correct, that you are the properly authorized user of the credit or debit card, or any electronic cash, which you use and that there are sufficient funds or credit facilities to cover the cost of any goods or services. We reserve the right to obtain validation/payment authorisation of your credit or debit card details before providing you with any goods or services.
Payment will be requested from the appropriate source detailed in your order request just prior to the Products ordered being dispatched to you.

UK and European Union Customers - All prices are subject to 17.5% Value Added Tax (VAT).
International Customers - VAT is not chargeable. Please check the exempt box to reduce VAT to zero .

E-Forms - If Applicable,
This is a legal agreement between you, the user, and Chancellor Formecon Ltd (CFL). By installing the software package you agree to be bound by the terms of this agreement. If you do not agree to these terms, you must promptly return all the CFL software items, e.g. PDF packs within a period of 30 days for a full refund.

You may use one copy of the software on only one computer at a time. "Use" means to load in temporary memory or permanent storage on the computer. Installation on the network server solely for distribution to other computers is not "use" if you have a separate licence for each computer to which the software us distributed. If users exceed the number of licences you must have a reasonable process to assure that the number of persons using the software concurrently does not exceed the number of licences.

All intellectual property rights in the software are owned by CFL and are protected by United Kingdom copyright laws and international treaties. CFL retains all rights not expressly granted. You may make one copy of the software solely for backup and archival purposes or transfer it to a single hard disk provided you keep the original solely for backup or archival purposes. You may not rent, lease, loan or distribute the software or copy the written materials accompanying the software, but you may transfer the software and all accompanying materials on a permanent basis if you retain no copies and the recipient agrees to the terms, hereof. Any transfer must include the most recent update and all prior versions. You may not reverse engineer, decompile or disassemble the software.

Limited Warranty

CFL warrants that the software disks are free from defects in materials and workmanship under normal use for thirty (30) days from the date you receive them. This warranty is limited to you and is not transferable. Any implied warranties are limited to 30 days. The entire liability of CFL and its suppliers, and your exclusive remedy, shall be (a) return of the price paid for the software or (b) replacement of any file that does not meet this warranty which is sent with a return authorisation number to CFL, at your cost and risk. This limited warranty is void if any disk damage has resulted from accident, abuse, misapplication, or service or modification by someone other than CFL. Any replacement disk is warranted for the remaining original warranty period or 30 days, whichever is longer.

CFL does not warrant that the function of the software will meet your requirements or that operation of the software will be uninterrupted or error free. You assume responsibility for selecting the software to achieve your intended results, and for the use and results obtained from the software.

CFL disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, for the software and all accompanying written materials. This limited warranty gives you specific legal rights. In no event shall CFL or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of use or inability to use the software, even if it is advised of the possibility of such damages.

This licence is effective until terminated. It will terminate upon the conditions set forth above or if you fail to comply with any term hereof. Upon termination you agree that the software and accompanying materials, and all copies thereof, will be destroyed. You acknowledge that you have read this agreement, you understand it, you agree to be bound by its terms and that this is the complete and exclusive statement of the agreement between you and CFL regarding the software.
Delivery You may return any Products you have purchased within 14 working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including e-mail) within those 14 working days. You will then be entitled to a refund from Chancellor Formecon, which will be paid as soon as possible, but in any event within 30 days. You must arrange for and pay the costs of returning the Products to Chancellor Formecon. On request, we will arrange for the Products to be collected from you, but the cost of this will be charged to you and we may deduct this from the refund. Products you intend to return to us must be in their original condition and suitable for resale.
If:
· the Product delivered is not what you ordered, or does not correspond with its description; or
· the Product delivered is not of a satisfactory quality; or
· the Product is not fit for any other purpose for which you have bought it and you notified Chancellor Formecon of this purpose before purchase, and Chancellor Formecon has not informed you that the Product is not fit for that purpose;
then Chancellor Formecon will, at its option, deliver to you a replacement Product or refund to you the price paid and your reasonable costs of returning the Products.

Delivery Schedule To UK addresses, we offer two delivery options:-

1) Standard delivery (please allow 5 working days from receipt of order) - £6.95

2) Express delivery (please allow 2 working days from receipt of order) - £8.95

Modifications to Website We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content and/or the sale of new Products and/ or the release of new software tools or resources shall be subject to these terms and conditions.
Please note that although we try to ensure that the content of our website is accurate, our website may contain typographical errors or other inaccuracies.
Information you provide to us The following applies to any information you provide to us, for example during any registration or ordering process.

You warrant and undertake that you will not use our website for any purpose that is illegal or prohibited by these terms and conditions, including without limitation the posting or transmitting of any libellous, defamatory, inflammatory or obscene material. If you breach these terms and conditions then your permission to use this website terminates immediately without the necessity of any notice being given to you. We retain the right to deny access to any person who fails to comply with these terms and conditions.
Security You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, e-mail verification and password that may be given to you or selected by you for use on our website. You may not share these with or transfer them to any third parties. You must notify Chancellor Formecon immediately of any unauthorised use of them or any other breach of security regarding our website that comes to your attention.
Applicability of online materials Unless otherwise specified all content and materials published on our website are presented solely for your private, personal and non-commercial use (except, for the avoidance of doubt, the Products available for purchase through the Chancellor Formecon website).
Our website is controlled and operated by us from our offices in England. Where content published on the website is supplied by third parties, you understand that we do not control or endorse such content in any way. In the unlikely event that you wish to return an item, please contact our Customer Services Department on 01270 758775, requesting a Returns Authorisation (RA) number. We regret we are unable to accept goods returned without an RA number.
Copyright and monitoring The contents of our website are protected by international copyright laws and other intellectual property rights. The owner of these rights is Chancellor Formecon, its affiliates or other third party licensors. All product and company names and logos mentioned in our website are the trade marks, service marks or trading names of their respective owners, including us. These terms and conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.
Except in respect of a payment obligation, neither you nor Chancellor Formecon will be held liable for any failure to perform any obligation to the other due to causes beyond your or Chancellor Formecon respective reasonable control.
Failure or delay by either party enforcing an obligation or exercising a right under these terms and conditions does not constitute a waiver of that obligation or right.
These terms and conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

Notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.

Replacement
These terms and conditions replace all other terms and conditions previously applicable to the use of our website and/or sale of the Products.
